CCAP Presents Roundtable Training!

TOPIC & SPEAKER: New Realignment Legislation, or "What Did They Do to PC 1170?!" with Cynthia Sorman, CCAP Staff Attorney

New legislature has drastically changed the definition of felony and misdemeanor under AB 109, AB 116, AB 117, AB 118.  These bills cumulatively affect every new felony sentence as of October 1. Under “realignment” a convicted felon of certain designated crimes will still be sentenced to prison – everyone else goes to county jail for one year or more.  County jail felons will be released on new county post-community release programs, not parole.

The modifications to Penal Code section 1170 are easily the biggest change in sentencing law since DSL law took effect.  Are you ready? 

For example, what discretion does the trial court have, who is eligible/ineligible for county placement, what is the new “post-community release” program, what is a “non-non-non,” what is the new definition of “guilty of a felony” in the statutes, do county jail sentences count as future prison priors, what about current sentences with prison priors or strike priors, does the new law change sentence lengths, what adverse consequences might exist, what about Romero discretion, and what about “pled & proved”?

These and other questions will be addressed by staff attorney Cindy Sorman in this special Roundtable training session on September 21.  Cindy will give an overview of the dramatic change in law and begin to sort these and other potential appellate issues.

MCLE:  This activity has been approved for 1 hour of MCLE credit (including 1 hour of Appellate and Criminal Law Specialist credit).

PARKING: Parking on J-Street is not recommended as metered parking is 25 cents per 15 minutes.  Instead, we recommend that you park on the surrounding community streets of 24th, 25th, or I-Street. (Note some of these streets have street-cleaning on Wednesdays, but the parking restriction expires at noon - thus the 10 minute delayed start time – CAUTION: do not park earlier than noon on the west side of 24th  and 25th streets!)
