TIP: Take the Notice of Appeal, the Application for Appoint of Counsel, and the defendant Background Information forms with you to sentencing. Assist those clients who need help to fill out all three forms. Forms can be found in the packages below.

File the Notice of Appeal with the Superior Court clerk.

Return the Application and Background Info forms to CCAP.

Please remind your client that if the Application for Appointment of Counsel form is not returned, or in the alternative, a brief filed on his/her own behalf is not timely received, the Court of Appeal will dismiss the appeal. Therefore, it is imperative that your client return the Application form to CCAP as soon as possible if appointed counsel is desired.

Third District Appeal Form Packages

Step 1: File the Notice of Appeal with the superior court clerk's office:

  1. Notice of Appeal – criminal felony cases
  2. Notice of Appeal – all juvenile cases (both dependency AND delinquency).

Step 2: Three different packages are available below, which include forms for both the trial attorney and the defendant/appellant to complete. Review the list and choose the one that best fits the case and client. Note that minors have a separate package from adult cases. Print all forms in the package.

  1. Criminal package – ADULT client / criminal felony cases
  2. Juvenile package – MINOR CLIENTS ONLY / both dependency & delinquency cases
  3. Dependency package – ADULT client / dependency cases

Step 3: Return the completed package of forms to CCAP by mail:

Step 4: Consider if you need to obtain a Certificate of Probable Cause for a guilty plea defendant.

Note that incarcerated / non-incarcerated adult clients have separate packages, and minors have separate packages from adult cases. Print all forms in the package.

  1. Incarcerated Adult – Criminal & Dependency Clients
  2. Non-Incarcerated Adult – Criminal & Dependency Clients
  3. Minor Client with dispo at Home – Delinquency & Dependency Clients
  4. Minor Client with dispo Out of Home Placement– Delinquency & Dependency Clients.

Step 3: Return the completed package of forms to CCAP by mail:
